Who can buy real estate in Montenegro?

Any foreigner can buy real estate in Montenegro. Foreign citizens can purchase any type of real estate in their own name, except for non-urbanized plots or construction plots with an area of more than 5000 sq. m. In order to purchase non-urbanized and large plots, it is necessary to register a company and buy the property as a company.

Who pays the agency's commission?

The agency's commission of 3-5% is paid by the seller.

What is the process of buying real estate in Montenegro?

  • After the client views the selected properties and makes the decision to buy, the notary prepares a contract of sale, which is signed in the presence of a professional court interpreter.
  • At the time of contract signing, a deposit is transferred (up to 20% of the value of the property), which constitutes the first installment for the property.
  • The payment of the remaining balance is made in accordance with the terms of the contract by bank transfer to the seller's account, in cash in the presence of the notary, through a notary escrow account, or by another agreed method. The payment period is determined by the contract terms and the property type.
  • After that, the presence of the buyer in Montenegro is not required. The agent or notary can take care of the remaining formalities.
  • After full payment has been made, the notary registers the new owner in the property cadastre of Montenegro.

What are the expenses incurred by the buyer?

  • Notary fees depending on the value of the property
  • Oral and written translation fees (€25-50 per hour, €20-30 per page)
  • Fee for registering the title in the property cadastre (approx. €30)
  • In case of secondary real estate purchase, a tax of 3% of the total value of the property

As a property owner, can I reside permanently in Montenegro?

Yes, you can, together with your family (spouses and children under 18). To obtain a residence permit, the following documents are to be submitted to the Ministry of Internal Affairs:
  • signed application form
  • certificate of ownership of real estate* (List nepokretnosti)
  • *any real estate, except for commercial premises, land plots without buildings, and ruins
  • proof of financial solvency (€3,650 per family member per year deposited in a Montenegrin bank account)
  • passport valid for at least 1 year with copies of all pages
  • proof of a clean criminal record from the place of permanent residence
  • proof of medical insurance valid for at least 1 year, purchased from an insurance company in Montenegro
The completed application form with all documents must be submitted in person to the Ministry of Internal Affairs. The application fee is €25 per person. The application processing time is one month. Temporary residence permit is issued for a period of 1 year and can be renewed for subsequent one-year terms.

As a property owner, can I obtain a permanent residence permit for 5 years?

Yes, in order to obtain a permanent resident permit, you have to live for at least 5 years in Montenegro, renewing the temporary residence permit in time and staying in the country for at least 11 months a year.
